It is not uncommon for divorcing parties to expect litigation. When you get divorced you go to trial, correct? That is actually a common misconception. While some contested cases may very well go to litigation, the majority of cases are now settled through mediation and other ADR ("Alternative Dispute Resolution") mediums such as negotiation and arbitration. What Is Mediation?

Mediation is when a conflict/dispute is resolved through a third-party neutral (the mediator). The mediator facilitates communication and negotiations between the parties. Unlike a judge, a mediator does not force either party into an agreement. Rather, it is completely up to the parties to come up with an agreement customized to their specific needs. Everything is strictly confidential in a mediation. There is also the protection against bringing in third parties such as witnesses. The main goal of mediation is to come up with an amicable resolution that satisfies both parties without the stresses of litigation.

What Are The Benefits Of Mediation?

There are many benefits to utilizing mediation over litigation. One major benefit is the cost. For the most part, mediation is much less costly than litigation. Secondly, mediation often is more efficient. An entire divorce agreement can be figured out through mediation. Litigation can often drag out for months or even years. Third, it gives the parties an opportunity to truly communicate their differences. Judges do not really want to listen to any information that doesn't pertain to the issues. But sometimes there are nondivorce issues that need to be hashed out to successfully resolve a dispute.

Finally, one of the biggest benefits in a mediation is for any children involved in a divorce. Children are never brought into a mediation. Furthermore, when a dispute is resolved in mediation amicably, this can further protect the child from anymore stress than necessary.
